Dramafy respects intellectual property rights and expects everyone who uses Dramafy to do the same. This page explains how to report content you believe infringes your copyright or other intellectual property rights, how we respond, and how a user whose content was removed can file a counter-notice.
This policy is provided for notice under the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and we apply analogous procedures under other applicable local laws. It is not legal advice. If you are unsure whether you have a valid claim, please consult a lawyer.
1. What this policy covers
You can use this procedure to report:
- characters, names, backstories, or descriptions that copy your copyrighted work;
- avatars, images, or artwork uploaded without your permission;
- voices or audio clips used without your permission;
- trademarks used in a misleading or infringing way.
For content that is harmful, hateful, sexual, or otherwise violates our Community Guidelines or Content Policy — but does not involve your intellectual property rights — please use the in-product Report button instead, or email [email protected].
2. How to submit a notice
Send a written notice to [email protected] that includes all of the following. A complete notice helps us act quickly; incomplete notices may be returned.
- Your identification and authority. Your full legal name, mailing address, telephone number, and email address. If you are acting on behalf of a rights holder, state your relationship and authority to act (for example, "authorized agent of [rights holder]").
- Identification of the copyrighted work or other intellectual property you claim has been infringed. If you are asserting multiple works, a representative list is acceptable.
- Identification of the allegedly infringing material on Dramafy. Provide enough detail for us to locate it — ideally the character ID, direct URL, username, and/or screenshots.
- A good-faith statement that you believe in good faith that the use of the material in the manner complained of is not authorized by the rights holder, its agent, or the law.
- An accuracy statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or authorized to act on the rights holder's behalf.
- Your physical or electronic signature.
Please submit your notice in English for fastest processing.
3. How we respond
Upon receiving a complete notice, Dramafy will:
- Acknowledge receipt within 2 business days.
- Review the notice for completeness and obvious defects.
- Take action on complete, valid notices — typically by removing or disabling access to the identified content. We aim to act within 7 business days for clear cases and within 14 business days for cases requiring investigation. We may act faster for urgent claims or slower for complex ones, and we will tell you which applies.
- Notify the affected user of the action taken, the substance of the notice (with your contact information redacted where practical), and how to file a counter-notice.
- Track repeat infringers. Users who are the subject of multiple valid notices may have their Creator status or account terminated under our repeat-infringer policy (§6).
4. How to submit a counter-notice
If you are a Dramafy user whose content was removed under this policy and you believe it was removed by mistake or misidentification, you may file a counter-notice by emailing [email protected] with the subject line COUNTER-NOTICE. Your counter-notice must include:
- Your full legal name, mailing address, telephone number, and email address associated with your Dramafy account.
- Identification of the material that was removed and the location where it previously appeared.
- A good-faith statement, under penalty of perjury, that you believe the material was removed or disabled as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, the United States Federal District Court for the district in which Dramafy's U.S. entity is located), and that you will accept service of process from the person who submitted the original notice or their agent.
- Your physical or electronic signature.
Once we receive a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action seeking to restrain the allegedly infringing activity, we may, at our discretion, restore the removed content.
5. False claims
Under the DMCA and similar laws, knowingly sending a false notice or counter-notice can result in legal liability, including damages, costs, and attorney's fees. Dramafy may also terminate the accounts of users who abuse this process.
6. Repeat-infringer policy
Dramafy maintains a repeat-infringer policy in accordance with 17 U.S.C. § 512(i) and equivalent obligations. Users who are the subject of multiple valid infringement notices over a reasonable period may:
- lose Creator status;
- have characters and content removed;
- have their account suspended or permanently terminated.
What counts as "multiple" and "reasonable period" depends on the circumstances, including the severity of the infringement and the user's response to prior notices.
7. Trademarks and other intellectual property
You can use the same procedure to report trademark infringement, rights-of-publicity violations, and similar intellectual property concerns. Please make clear in your notice which right you are asserting so we can apply the correct analysis.
